1.0 Our Core Beliefs On User Privacy and Data Protection

I believe that user privacy and data protection are essential elements of your rights as a customer. We have a duty of care to those customers with whom we hold their personal information.

We will only collect and process data that is absolutely necessary to give you the best experience possible while navigating through our website and making a purchase.

We hate spam as much as you do.

We will never ever sell, rent or distribute your personal information to anyone not directly involved in the provision of the services that you have requested of us.

2.0 Information We Collect and Why:

This website collects and uses personal information for the following reasons:

2.1 Site Visitor Tracking

Like most websites, our site uses website analytics to track your interaction. We use this data to determine the number of people using our site, to better understand how they find and use our web pages, and to see their journey through the website in order to make improvements to user experiences in the future.

Although analytics stores data such as your geographical location, device, internet browser, and operating system, none of this information enables anyone to identify you. We consider these analytics to be a third-party data processor (see section 6.0 below).

2.2 Site Security and Protection

All data sent to or from our site is encrypted using SSL/TLS.

3.4 Customer Orders

In order to send your purchase or send you a newsletter, we will collect your contact details.

If you add products to your shopping cart, we use cookies to keep track of your cart contents while you’re browsing the rest of our site. On placing an order, we ask you for key information regarding your billing address and delivery details in order to fulfill that request. This information is stored only on our servers and is only shared with our payment processing (PayPal Braintree) in order to take payment. Both Braintree and PayPal are considered to be third-party data processors (see section 6.0 below).

If you order a print, your order and shipping information may be shared with the printer, currently Electric Works (see section 6.0 below). No payment information is shared with such a third party.

In order for us to provide our lifetime limited warranty, we store your name, email address, postal address, and delivery information on our systems for the life of each product you purchase.

At the point of order confirmation, you also have the option to create a user account on our site. By doing so, you also agree to our terms and conditions and this privacy policy.

As part of the user account creation process, your name, email address, postal address and delivery information will be stored as a unique account with your email address and password of your choice on our servers. Our systems encrypt this information via SSL, and you can edit your own account information at any time by visiting the “my account” section on the website.

3.5 Our Blog

Should you choose to add a comment to any posts that we have published on our blog, the name and email address you enter with your comment will be saved to our website’s database, along with your computer’s IP address and the time and date that you submitted the comment.

This information is stored in the US and not shared with any other service. It is only used to identify you as a contributor to the comment section of the respective blog post and is not passed on to any of the third-party data processors detailed below.

Your comment and its associated personal data will remain on this site until we see fit to either 1.) remove the comment or 2.) remove the blog post. Should you wish to have the comment and its associated personal data deleted, please contact our privacy email address, from the email address that you commented with – sending a link to the comment and blog post in question.

If you are under 16 years of age, you must get parental consent before posting a comment on our blog.

NOTE: You should avoid entering personally identifiable information into the actual comment field of any blog post comments that you submit on this website.

3.6 Contact forms and email links

If you decide to contact us using the contact form or by email at info@marksullivanart.com, none of the data that you supply will be stored by this website or passed to / be processed by any of the third-party data processors defined in section 6.0. Instead, the data will be collated into an email and sent to us over the Simple Mail Transfer Protocol (SMTP).

Our own SMTP servers are protected by TLS (also known as SSL) meaning that the email content is encrypted before being sent across the internet. The email content is then decrypted by our local computers and devices.

However, not all mail servers are secured in such a way. Therefore, we would suggest that you always consider email as an insecure medium and not include any financial or personal information that you would not want to be public.

3.8 Email Newsletter

We use a “double-opt-in” system, which requires your confirmation to an automated email that is sent at the point of sign-up to ensure you intended to receive our newsletters in the future.

Your email address will remain within our database until you specifically request removal from the list. You can do this by unsubscribing using the unsubscribe links contained in any email newsletters that we send you or by unsubscribing in your account on the website or email info@marksullivanart.com. When requesting removal via email, please send your email to us from the email account that is subscribed to the mailing list.

If you are under 16 years of age, you must get parental consent before joining our email newsletter.

4.0 How We Store Your Personal Information

As detailed in sections 3.4 and 3.5 above, if you submit an order, or make a comment to a blog post published on our website, some personal information will be stored within our database. This is currently the only occasion where your personal data will be stored by us. This data is currently stored in an identifiable fashion but protected via SSL and strong username and password combinations. There are other security measures in place.

Our website may contain links to other sites. Please be aware that we are not responsible for the privacy practices or the content of such third-party websites or any information they might collect. We encourage you to be aware when you leave our website, the privacy policy of those websites may differ from ours.

8.0 Data Breaches

We will report any unlawful data breach of this website’s database or the database(s) of our third-party data processors to all relevant persons and authorities within 72 hours of the breach if it is apparent that personal data stored in an identifiable manner has been stolen.

9.0 Data Removal

You may request and/or remove of all personally identifiable information we hold about you.

With our third-party processors, an application for such a request or removal should be made directly to them.

For removal from our website, email info@marksullivanart.com using the email address that you provided at the point you placed an order, made a blog comment, or registered for an account. All requests will be responded to within 21 days.

Please note that by nature of our lifetime warranty provision, the removal of all data we hold about you as a customer will prevent us from being able to offer this guarantee and will therefore invalidate your warranty from that point.

10.0 Changes To Our Privacy, Data, and Cookie Policy

This privacy policy may change from time to time. We will not explicitly inform our clients or website users of these changes. We will mention changes in our newsletter. We also recommend you check this page occasionally for any policy changes.
